1. Acceptance of Terms
By submitting your information through any form on https://www.piercehomes.net/ (the "Site"), by clicking "I agree" or a similar button, by responding to one of our advertisements, or by otherwise using our services, you ("you" or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). Pierce & Pierce Holdings LLC, an Indiana limited liability company doing business as Pierce Homes ("Pierce Homes," "we," "us," or "our"), appreciates your interest. If you do not agree to these Terms, do not use the Site or our services.
2. Who We Are
Pierce & Pierce Holdings LLC, doing business as Pierce Homes, is a family-owned real estate investment company located at 1003 E 106th St, Indianapolis, IN 46280. We purchase residential real estate for cash, assign or resell purchase contracts to other buyers, hold properties as rentals, and, through a licensed affiliate, list properties for sale. We are not a lender, title company, law firm, or tax advisor.
Real estate license disclosure. Javier Hernandez, owner of Pierce & Pierce Holdings LLC, holds an active Indiana real estate broker license (RB24000550) with Indiana Ford Realty. When Pierce Homes makes an offer to purchase your property, it is acting as a principal buying for its own account or for assignment to another buyer, not as your agent. We do not represent you in any transaction unless you and we sign a separate written agency agreement.
3. Changes to These Terms
We may modify these Terms at any time by posting the updated version on the Site with a new "Last Updated" date. Your continued use of the Site or our services after changes are posted means you accept the revised Terms.
4. Use of the Site and Our Services
You agree to use the Site and our services only for lawful purposes and in accordance with these Terms. You agree that you are at least 18 years old and that any information you submit about yourself or a property is accurate and that you have the right to share it. You agree to interact with our team in a respectful, professional manner. Harassment, abuse, threats, or disruptive conduct may result in our declining to do business with you. We reserve the right to decide what conduct violates this section.
5. Consent to Calls, Text Messages, and Emails
By providing your phone number and submitting a form on the Site or through one of our advertisements, you expressly consent to receive calls and text messages (SMS/MMS) from Pierce Homes, its owners, employees, and agents at the number you provided, including calls and texts made using an automatic telephone dialing system, artificial or prerecorded voice, or other automated technology. These communications may relate to your property, your request for an offer, follow-up on your inquiry, and information about our services, and may be informational, transactional, or promotional in nature.
Consent is not a condition of purchase or of receiving an offer on your property.

You may opt out of text messages at any time by replying STOP to any message. Reply HELP for assistance.
You may ask us to stop calling by telling the caller or by emailing jshernandez1717@gmail.com.
You may unsubscribe from promotional emails using the link in any email.
You agree that you are the subscriber or customary user of the phone number you provided and that you will notify us if you stop using that number. Opting out of communications may limit our ability to make or follow up on an offer for your property.
6. Offers and Transactions
Any offer, price range, estimate, or valuation we provide through the Site, by phone, by text, or by email is preliminary and non-binding unless and until both parties sign a written purchase agreement. Offers are based on the information you provide and on our own analysis, and may change after inspection, title review, or other due diligence. Nothing on the Site is a guarantee that we will purchase any property or pay any particular price. We may assign our rights under a purchase agreement to a third party as permitted by that agreement.
7. No Professional Advice
Information on the Site and in our communications is for general informational purposes only and is not legal, financial, tax, or investment advice. You should consult your own attorney, accountant, or advisor before selling a property or entering into any agreement.
8. Publicity Release
You irrevocably and perpetually grant us the right to photograph, videotape, and record your name, voice, appearance, likeness, and/or written testimony, along with any material furnished by you, in whole or in part, in any of our marketing materials and programs.
9. Confidentiality
You agree to treat non-public information we share with you during the course of a transaction — including offer terms, purchase prices, buyer information, and internal communications — as confidential and not to disclose it to third parties except to your own attorney, accountant, or advisor, or as required by law.
10. Intellectual Property
The Site and its content, including text, graphics, logos, photographs, videos, and the Pierce Homes name, are owned by us or our licensors and are protected by copyright and trademark law. You may not copy, reproduce, or distribute Site content without our written permission.
11. Third-Party Links and Services
The Site may link to or refer you to third-party websites, products, or services, including title companies, lenders, and real estate professionals. We do not control and are not responsible for third-party content or services and do not endorse them. Some third parties we refer you to may have a business relationship with us. Your dealings with any third party are solely between you and that party.
This Site is not part of, and is not endorsed by, Facebook, Instagram, Meta, Google, YouTube, or Microsoft. FACEBOOK and INSTAGRAM are trademarks of Meta Platforms, Inc. YOUTUBE is a trademark of Google LLC.
12. Disclaimer of Warranties
The Site and our services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the maximum extent permitted by law, Pierce & Pierce Holdings LLC and its owners, members, employees, agents, affiliates, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, arising out of or relating to (a) your access to or use of, or inability to access or use, the Site or our services; (b) any conduct or content of any third party; (c) any content obtained from the Site; or (d) unauthorized access to or alteration of your transmissions or content — whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms or your use of the Site shall not exceed one hundred dollars ($100). Nothing in this section limits liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless Pierce & Pierce Holdings LLC and its owners, members, employees, agents, affiliates, and representatives from any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or any inaccurate information you provide to us.
15. Governing Law and Arbitration
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms, the Site, or our services shall be resolved by binding arbitration administered by the American Arbitration Association (www.adr.org) under its Consumer Arbitration Rules. The arbitration shall take place in Hancock County, Indiana, and be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You and we each waive the right to a jury trial and the right to participate in a class action. Either party may bring an individual claim in small claims court instead of arbitration. If a party files a lawsuit and the matter is later moved to arbitration under this section, the filing party shall pay the other party's reasonable attorneys' fees incurred up to the matter's submission to arbitration.
Nothing in this section applies to disputes under a signed purchase agreement, which are governed by the dispute-resolution terms of that agreement.
16. Privacy Policy
By using the Site or our services, you acknowledge that you have read and agree to our Privacy Policy at https://www.piercehomes.net/privacy-policy-4, which explains how we collect, use, and share your information.
17. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor or affiliate.
